According to the jurisdiction of the European Court of Human Rights and the Austrian Constitutional Court, the right of children and juveniles to sexual autonomy (sexuelle Selbstbestimmung) is protected by the European Convention of Human Rights and the Austrian Federal Constitution in a comprehensive way, namely the right to be protected against unwanted sexuality as well as the right to wanted sexuality. In the first part of this work it is analysed to what degree the current legal norms in the criminal law concerning sexuality are able to guarantee this comprehensive protection. The second part is a collection of materials and contains a review of all available empirical studies in German and English language and a so far unique comparison of all European as well as the major Extra-European jurisdictions regarding the protection of youth in the sexual criminal law including a documentation of the pertinent norms themselves.
